1. ACCEPTANCE:

1.1 This document sets forth the terms and conditions for the use of the services provided by the PLATFORM, constituting a contract between the USERS and the FATAL MODEL. By using the services offered through the PLATFORM, you expressly agree to all the terms outlined herein, as well as to the applicable legal provisions. You also represent that the jurisdiction from which you access the Website does not prohibit the receiving or viewing of sexually explicit Content.

1.2 If you DO NOT AGREE with the provisions set forth in this document, DO NOT access, view, download, or use in any way any page, content, information, or service of FATAL MODEL.

1.3 We reserve the right to modify or update the Terms of Use periodically. By continuing to access or use the Site, you agree to be bound by the latest version of the Terms of Use.

1.4 You must be at least 18 years old to register or use the Services provided through the Site. By continuing to use these Services, you confirm that you are at least 18 and have the authority to accept the Terms of Use. Users found to be underage may have their accounts terminated. The platform is following the UK and EU regulations.

1.5 For the purposes of these Terms and Conditions, the users of the PLATFORM are classified as USERS: (i) Users Viewers: those who access the PLATFORM without registering; (ii) Service Providers: individuals who register on the PLATFORM to offer their services; and (iii) Clients: users who register to seek and contract the services offered by the Companions.

1.6 The data collected from the Service Providers includes: full name, gender, date of birth, phone, email, location, professional profile information (description of services, values, price, media such as profile, gallery, listing, stories, etc.), the services that are filled in, and personal characteristics (ethnicity, skin color, hair, eyes, spoken languages, weight, height, whether they have a location or not, whether they are a smoker, have tattoos, etc.).

1.7 The data collected from the Clients includes: date of birth and contact information (email).

1.8 All users must verify their age to access the platform, in compliance with UK and EU regulations.

2. LIMITATIONS OF LIABILITY:

2.1 FATAL MODEL is only a PLATFORM for the assignment of advertising space, and its responsibility is restricted solely to the correct operation of the PLATFORM and its features in accordance with this instrument, and FATAL MODEL has no responsibility for:

1. (i) any negotiations carried out between USERS;
2. (ii) verification that the ADVERTISER actually holds the qualification stated in their advertisement;
3. (iii) the quality of the advertisements;
4. (iv) making any payment agreed between the USERS;
5. (v) any damages arising from third-party events, including, but not limited to, hacker attacks and malicious software;
6. (vi) any other act or fact arising from the conduct of USERS.

2.2 The PLATFORM is not responsible for interruptions or unavailability of the Site caused by external factors beyond its control, including, but not limited to, failures of internet service provider equipment, interruptions in communication networks, or other events of force majeure or act of God.

2.3 The PLATFORM is not responsible for content generated by third parties and its Users. This includes, but is not limited to, texts, images, videos, links to external websites, and any other information or materials. The presence of links to external websites does not imply endorsement or responsibility of Fatal Model for the content of these sites. Users are exclusively responsible for the evaluation and use of any third-party content

3. REGISTRATION:

3.1 USERS must complete the registration process by providing all required information and affirming that they are of legal age, fully capable, and have the capacity to agree to these terms and conditions.

3.2 It is the sole responsibility of USERS to provide, update, and ensure the accuracy of their registration information. The PLATFORM shall not be held liable for any civil or criminal consequences arising from inaccurate, incorrect, or incomplete data provided by USERS.

3.3 Creating more than one registration per USER on the PLATFORM is strictly prohibited. If multiple registrations by a single USER are detected, the PLATFORM reserves the right, at its sole discretion and without prior notice or compensation, to disable all existing registrations associated with that USER and to refuse any new registrations from that USER.

4. USER RESTRICTIONS:

4.1 USERS are prohibited from using the PLATFORM for any illegal, defamatory, discriminatory, abusive, offensive, aggressive, insulting, vexatious, misleading, slanderous, violent, vulgar, harassing, threatening, or fraudulent purposes. This includes any actions that may cause harm to the PLATFORM, other USERS, or third parties.

4.2 USERS are prohibited from using false information, impersonating others, or employing images for which they do not hold ownership rights or do not have explicit permission to publish. This includes any attempts to mislead, deceive, or misrepresent themselves or others on the PLATFORM.

4.3 The publication, disclosure, or sharing of any content that involves, refers to, or is related to minors is strictly prohibited, including, but not limited to, images, stickers, videos, texts, or any other form of representation of children or adolescents.

4.4 In the event of any violation of these Terms and Conditions, FATAL MODEL reserves the right, at its sole discretion, to immediately suspend or ban the user's profile and access to the PLATFORM, without prior notice or liability

5. IMAGE USE LICENSE

5.1 All content uploaded by users remains their property. However, by uploading content, you grant FATAL MODEL a non-exclusive, royalty-free, transferable, and worldwide license to use, modify, and display your content as part of our service.

5.2 The platform will limit access to content that may expose sensitive material to minors, in compliance with applicable legislation in the United Kingdom and the European Union. The implementation of such limits on image access stems from a legal and regulatory obligation, not implying any additional responsibility on the part of the platform in relation to the content itself, as it acts merely in compliance with established norms.

6. TERMINATION OF ACCOUNTS

6.1 We reserve the right to terminate accounts that violate these terms, users that are less than 18 years old or act in a manner deemed inappropriate or illegal. Such accounts may be deleted without prior warning.

7. DATA PROTECTION:

7.1 We are committed to protecting your personal information. We collect and process data in accordance with the GDPR guidelines. By using this website, you consent to the collection, storage, and use of your personal data as outlined in our Privacy Policy.

7.2 We use your data to facilitate transactions and provide customer service, send important updates related to the platform's operation and personalize your experience and improve our services. Your data will not be sold to third parties.

9. INTELLECTUAL PROPERTY RIGHTS:

9.1 The USER expressly acknowledges that, through this instrument, they receive from FATAL MODEL a license to use the PLATFORM, which is non-transferable, being prohibited sublicensing for use in national or foreign territory, for as long as the membership to this term lasts, and the use of the PLATFORM in disagreement with the provisions of this instrument is prohibited.

9.2 All materials, patents, trademarks, registrations, domains, names, privileges, creations, images and all related rights related to the PLATFORM and developed by FATAL MODEL are and shall remain the sole and exclusive property of FATAL MODEL, and the USERS agree not to perform any act or fact that in any way impairs the rights provided for herein, nor to claim any right or privilege over them.

9.3 The Service Providers authorizes, freely, unrestrictedly, irrevocably, and irreversibly, FATAL MODEL to use their image in advertisements placed on the PLATFORM, whether in photo, audio, or video format, without this implying any violation of their image rights.

10. MISCELLANEOUS

10.1 FATAL MODEL may change this instrument at any time, by simply publishing a revised version on our website. For this reason, we strongly recommend that you always visit this section of our Site, reading it periodically. But, to contribute to a good relationship, we may also publish a notice about these changes.

10.2 FATAL MODEL may at any time, without prior notice or compensatory consideration, edit and/or exclude existing functionalities, as well as include new functionalities to the PLATFORM.
